1. Agreement to Terms
By using PawsAcross (“Service,” “we,” “us,” or “our”), you agree to these Terms & Conditions. If you do not agree, do not use our services. These terms apply to the website (pawsacross.com), mobile app, and all services provided by PawsAcross.
2. Description of Service
PawsAcross provides pet transportation and veterinary coordination services, including:
- Door-to-door pet transport from San Diego to Tijuana and back
- Coordination with licensed veterinary partners in Tijuana, Mexico
- Document handling for border crossings
- Digital record-keeping and communication services
PawsAcross is a transportation and coordination service. We are not a veterinary practice and do not provide medical advice. All medical decisions are made by licensed veterinarians at our partner clinics.
3. Eligibility
You must be at least 18 years old and the legal owner (or have legal authority to authorize veterinary care for) the pet being transported. By booking a service, you represent that you have this authority.
4. Bookings and Payment
- All bookings are subject to availability and final confirmation by PawsAcross
- Prices are provided as estimates and confirmed before final booking
- Payment is due at the time of booking confirmation unless otherwise arranged
- Payments are processed securely by Stripe
- All prices are in US Dollars (USD)
5. Cancellations and Refunds
- 72+ hours before pickup: Full refund
- 24–72 hours before pickup: 50% refund
- Under 24 hours before pickup: No refund (courier and vet time has been allocated)
- PawsAcross cancellations: Full refund if we cancel for any reason
- Border delays beyond our control: We will reschedule at no charge
6. Your Responsibilities
As the pet owner, you are responsible for:
- Ensuring your pet's vaccinations are current and records are available
- Disclosing any known medical conditions, behavioral issues, or aggression
- Ensuring your pet is fit for transport (not severely ill, post-major-surgery, etc.)
- Providing accurate pickup and contact information
- Being reachable by phone on the day of the trip
Failure to disclose a known aggressive behavior that results in injury to a courier or other animal may result in additional liability to you.
7. Liability Limitations
Medical outcomes: PawsAcross is not liable for the outcome of any veterinary procedure. All medical decisions are made by licensed veterinarians. We do not guarantee any specific medical result.
Transport: PawsAcross carries commercial liability insurance for pets in our care during transport. In the event of injury, illness, or death of a pet while in our custody, our liability is limited to the documented veterinary cost of treatment or the replacement value of the animal as documented, whichever is applicable.
Border delays: PawsAcross is not liable for border crossing delays, changes in crossing requirements, or actions by CBP, USDA, or SENASICA. We will make every reasonable effort to facilitate your pet's crossing but cannot guarantee crossing times.
Force majeure: PawsAcross is not liable for delays or failures caused by events beyond our control, including natural disasters, government actions, road closures, or public health emergencies.
8. Border Documentation
You acknowledge that:
- Crossing requirements can change without notice at the discretion of CBP, USDA, or Mexican authorities
- As of November 2024, a Screwworm Inspection Certificate is required for all dogs returning from Mexico — we include this in every Mexico dog booking
- You must ensure your pet's rabies vaccination is current before the trip date
- PawsAcross is not liable if a crossing is denied due to documentation issues arising from information you provided that was inaccurate or incomplete
9. Independent Courier Partners
Pet transportation is performed by independent Courier Partners: independent contractors who operate their own courier businesses, not employees of PawsAcross. Depending on the state, a Courier Partner may operate as an individual independent contractor or, where required by applicable state law, through their own business entity (such as an owner-operator LLC or sole proprietorship) under a business-to-business agreement with PawsAcross. All Courier Partners are background-checked and are required to carry their own auto and liability insurance. PawsAcross maintains a separate commercial transport policy covering pets in transit.
10. Intellectual Property
All content on pawsacross.com — including text, graphics, logos, and software — is owned by PawsAcross or its licensors. You may not reproduce, distribute, or create derivative works without written permission.
11. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes will be resolved in the courts of San Diego County, California, or through binding arbitration if you prefer — contact legal@pawsacross.com.
12. Changes to Terms
We may update these Terms from time to time. Continued use of our services after changes constitutes acceptance of the new Terms. Material changes will be communicated by email.
